PREAMBLE

The present General Terms and Conditions of Sale define the rights and obligations of the parties in the context of sales made on the online sales site www.zeus-surf.com. ZEUS reserves the right to adapt or modify these terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in force on the day the order is placed will apply to each order. Any order for a Product offered on the site implies the Buyer's acceptance of the present terms and conditions of sale.

1- IDENTIFICATION OF SELLER AND CUSTOMER

2- CUSTOMER IDENTIFICATION ON THE SITE

Customers who have already made a purchase on the www.zeus-surf.com website may choose a password that will enable them, for subsequent orders, to avoid having to fill in the forms prior to placing an order.

The items presented on www.zeus-surf.com are presented while stocks last. The descriptions and photos illustrating them are as accurate as possible. However, www.zeus-surf.com cannot be held responsible for any errors or omissions. The photographs illustrating the products are not part of the contract.

4- VALIDITY OF THE OFFER

Any order placed on www.zeus-surf.com implies acceptance by the customer of the prices of the products and services offered for sale, as well as of the present General Terms and Conditions of Sale.
Sales prices are presented inclusive of all taxes, in Euros, Pounds Sterling, Dollars, or Australian Dollars, excluding order delivery charges where applicable. The VAT of the country of delivery of the order is that which applies to the amount of the order.
The prices of the products presented on www.zeus-surf.com are subject to change. Pride reserves the right to change prices without notice. The prices appearing at the time of purchase are the prices applicable to that purchase.

5- ORDERING AND DATA CONTROL

All orders validated on www.zeus-surf.com before 11:00 am (GMT+1h) from Monday to Friday will be prepared and dispatched the same day. After this time, orders will be dispatched on the next working day. This service time is not guaranteed on public holidays and during certain periods (busy periods, inventories, etc.).
ZEUS checks orders placed onwww.zeus-surf.com. These checks, based on various criteria, may lead our Customer Service to contact you to request additional proof.
Any suspected fraud will be investigated and, if necessary, prosecuted. ZEUS reserves the right to refuse any order for any reason whatsoever. ZEUS also reserves the right to cancel any purchase (order already accepted) without being held responsible for any damage or costs incurred, for the following reasons:

  • the product is no longer available
  • your order is identified by our security systems as unusual or likely to be fraudulent
  • we have reason to believe that you are a minor
  • we have reason to believe that you are a reseller
  • we are unable to deliver to the address you have provided.

6- PAYMENT

6.1/ PAYMENT SECURITY
Payment security on www.zeus-surf.com is taken very seriously. Bank transactions are secured by the Shopify Payment system. All information exchanged to process payment is encrypted using SSL protocol. This data cannot be detected, intercepted or used by third parties. Nor is it stored on our computer systems.
In addition, purchases made on www.zeus-surf.com are 3D-Secure compliant. 3D-Secure is a protocol developed by international issuers Visa (Verified By Visa) and Mastercard (Mastercard Secure Code) to enhance the security of online payments. This protocol is based on the implementation of an additional control during an online purchase: in addition to bank details, the buyer is asked to enter personal data enabling the bank to identify him/her and validate the transaction.

7- DELIVERY

7.1/ COUNTRY OF DELIVERY
All orders validated on www.zeus-surf.com before 11:00 am (GMT+1h) from Monday to Friday will be prepared and dispatched the same day. After this time, orders will be dispatched on the next working day. This service time is not guaranteed on public holidays and during certain periods (busy periods, inventories, etc.).

7.2/ DELIVERY PROBLEMS
The customer must notify the carrier and ZEUS via the contact form in the 'Questions' section of the site, of any reservations regarding the product received (e.g. damaged package, already opened, etc.) within 2 days of receipt of the product.
The customer may then benefit from the refund conditions provided for this purpose.

7.3/ PRICES AND DELIVERY TIMES
Metropolitan France, Corsica & Monaco :

  • 2 to 3 working days

These delivery times do not include preparation time. Orders validated before 11:00 am (GMT+1h) Monday to Friday will be prepared and dispatched the same day. 8- RETURNS

For complaints concerning products ordered (damaged products, non-conforming products) and in the context of exercising the right of withdrawal, the Customer may return products to ZEUS within 14 working days of receipt of said products by following the procedure below:

  • The customer must contact customer service using the form in theon the website
  • Return number: ZEUS customer service will provide the customer with a return number, which must be included with the returned products.
  • Condition of returned products: the customer must return products carefully packaged in a secure parcel and they must be in their original condition, ready for sale (unwashed, unworn, undamaged).

  • Return costs: return costs are at the customer's expense, or a flat-rate charge of 40 euros will be applied.
  • Responsibility for returns: the return of products is the responsibility of the Customer. ZEUS therefore recommends that the customer send the parcel by registered mail so that it can be tracked.
  • Verification of returns: upon receipt of the package, ZEUS will inspect the products in order to validate or not the return. If the return is not compliant, the products will be sent back to the Customer. If the return is validated, an email will be sent to the customer to inform them of the processing of their return.
Refunds:
  • For returns of defective or non-conforming products: if the return is validated, ZEUS will refund the amount of the products as well as the delivery charges to the Customer's account used to pay for the order.
  • For product returns in the context of retraction, ZEUS will only reimburse the amount of the products. Reimbursement will be made as quickly as possible and in any case within 14 days of receipt of the return.
  • Failure to comply with this procedure and deadlines, and without prejudice to applicable legal guarantees, will result in invalid claims, and the products supplied by ZEUS will be considered free of any defect.

9- EXCHANGES

Exchanges are not offered onwww.zeus-surf.com. Once your item has been returned, we invite you to place a new order online.

10- INTELLECTUAL PROPERTY

All elements of thewww.zeus-surf.com website, whether visual or audio, including the underlying technology, are protected by copyright, trademark law, patent law and image rights. They are the exclusive property of www.zeus-surfboards.com. Any hypertext link to www.zeus-surf.com using framing, deep-linking, in-line linking or any other deep-linking technique is strictly prohibited. In any case, any link, even tacitly authorized, must be removed on request from www.zeus-surf.com. In general, any total or partial reproduction of the www.zeus-surf.com websiteis strictly forbidden. 12- WARRANTY

All our products are covered by the legal warranty system, provided that they have been used in a normal manner and that maintenance instructions have been followed.
Article L211-4 of the French Consumer Code
The seller is bound to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L211-5 of the French Consumer Code
To conform to the contract, the good must:

  • 1º Be fit for the use normally expected of similar goods and, where applicable:
    - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
    - present the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
  • 2º Or present the characteristics defined by mutual agreement between the parties, or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.

Article L211-12 of the French Consumer Code
Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
Article 1641 of the French Civil Code
The seller is liable for any hidden defects in the goods sold which render them unfit for their intended use, or which impair this use to such an extent that the buyer would not have purchased them, or would have paid a lesser price for them, had he been aware of them.
Article 1648 paragraph 1 of the French Civil Code
The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.

13- INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

13.1/ PERSONAL INFORMATION
Personal information is processed by ZEUS for the purposes of customer relationship management and prospecting. To enable you to receive offers from our partners, we may communicate this information to them. In accordance with the French Data Protection Act of January 6, 1978, updated by the Act of August 6, 2004, customers have the right to access, rectify and object to data concerning them. The www.zeus-surf.com websitehas been registered with the CNIL under number: 1815206.

13.2/ COOKIES
The Site uses cookies. A cookie is a computer file stored on the hard disk of the Customer's computer. Its purpose is to indicate a previous visit by the Customer to the Site. Cookies are only used by www.zeus-surf.com to personalize the service offered to the customer. Customers may refuse cookies by configuring their Internet browser. In this case, he/she loses the possibility of personalizing the service delivered to him/her by ZEUS via the Site.

13.3/ WEB BEACONS
Certain web pages of the Site may contain web beacons which allow the number of visitors to the Site to be counted and/or provide ZEUS with a certain number of indicators. These Web beacons may be used with some of our partners, in particular to measure and improve the Site's efficiency. In any event, the information obtained via these Tags is strictly anonymous and is used simply to compile statistics on the number of visitors to certain pages of the Site, in order to better serve our Site's Customers.

14- MISCELLANEOUS PROVISIONS

14.1/ FORCE MAJEURE
ZEUS shall not be liable for the total or partial non-performance of its obligations under the present contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike, notably of postal services and means of transport and/or communication, flood or fire.
The Parties agree to consult each other as soon as possible in order to determine how the order will be processed during the period of force majeure.
After a period of one month of interruption due to force majeure, the Parties will be released from their obligations to each other.

14.2/ ENTIRE CONTRACT
The present general terms and conditions of sale and the order summary sent to the customer form a contractual whole summarizing all agreements between the parties.

14.3/ TRANSACTION STORAGE AND ARCHIVING
Invoices are archived on a reliable and durable medium in such a way as to correspond to a faithful and durable copy.

14.4/ APPLICABLE LAW - COMPETENT JURISDICTIONS
The present general terms and conditions of sale and the contractual relations between ZEUS and the customer are governed by French law. In the event of a dispute, the competent French courts shall have exclusive jurisdiction. However, ZEUS undertakes to seek an amicable solution before taking any legal action.
